www.iletaitunfil.com (hereinafter referred to as "the site") is published by IMAROQ S.A.S. with a share capital of 26900 euros, whose registered office is at Marseille (13006) - 14 boulevard André AUNE, registered in the Marseille Trade and Companies Register under no. 808 195 556 00028, intra-community VAT no. These general terms and conditions of sale govern exclusively the sale of products by S.A.S IMAROQ, which markets them under the brand name IL ETAIT UN FIL (hereinafter referred to as "IL ETAIT UN FIL").
S.A.S IMAROQ's general terms and conditions of sale may be modified at any time and will only be in force on the date the order is created.
You can check at any time the version of the general terms and conditions of sale applicable to any transaction and appearing on your order form at the time of ordering or on the www.iletaitunfil.com website. Consequently, placing an order implies acceptance of these terms and conditions of sale.
Article 1 - Prices
1.1 - The prices of our products are quoted in euros, inclusive of all taxes, and include free delivery within mainland France. For Europe, a fixed amount of 15 € HC will be added to the order.
1.2- IMAROQ S.A.S reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time your order is validated.
1.3- The products remain the property of IMAROQ until full payment has been received. We remind you that when you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
1.4 - IMAROQ S.A.S. is not intended to sell to professionals; the products are reserved for private individuals.
Article 2 - Ordering
2.1- Ordering
The www.iletaitunfil.com website allows you to order a selection of IL ETAIT UN FIL products from IMAROQ S.A.S..
Once you have placed your order, you will receive a confirmation email. If you have any queries about an order that has already been placed or about an exceptional order, please contact our Customer Service department by email (sales@iletaitunfil.com).
2.2-The Customer
The information requested includes: title, surname, first name, telephone number, email address, billing address and delivery address. When registering the Customer's personal data, the Customer must ensure that the data provided via the form is accurate. In the event of an error in the recipient's details, IMAROQ cannot be held responsible for the impossibility of delivering the product.
2.3-Products
Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks, in particular according to the constraints linked to its suppliers. All PRODUCTS sold by IMAROQ are new and comply with current European legislation and standards applicable in France.
IMAROQ takes the utmost care in the presentation and description of these products in order to provide the Customer with the best possible information. However, it is possible that non-substantial errors may appear on the Site, which the Customer acknowledges and accepts.
While every effort is made to ensure that the colour and design of IMAROQ products whose photos are displayed on the www.iletaitunfil.com website are faithful to the original products, variations may occur, in particular due to the technical limitations of colour rendering on your computer equipment. Consequently, IMAROQ cannot be held responsible for any errors or inaccuracies in the photographs or graphic representations of IL ETAIT UN FIL products shown on the www.iletaitunfil.com website. 2.4- Availability
In the event that a product is unavailable after you have placed your order, we will inform you by email or telephone as soon as possible, offering you either to order another item presented on the www.iletaitunfil.com website as a replacement, or to cancel your order.
2.5- Validating your order
You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. Confirmation of your order therefore implies acceptance of these General Terms and Conditions of Sale. A summary of your order information will be sent to you via the order confirmation e-mail.
2.6- Payment
We remind you that confirming your order implies your obligation to pay the price indicated.
Article 3- Delivery
3.1 - General information
Deliveries are made by La Poste within the time indicated in the order confirmation e-mail. Products are delivered against a signature to the delivery address you indicated during the order validation process.
3.2- Billing
IMAROQ offers delivery to Metropolitan France. For international deliveries, IMAROQ reserves the right to apply an additional charge of 10 euros (incl. VAT), previously stipulated on the order form when the order is validated.
3.3-Timelines
The times indicated are indicative times, corresponding to average processing and delivery times. IMAROQ shall not be held liable for any consequences resulting from delays in delivery for which it is not responsible.
3.4-Responsibility
We remind you that when you (or a third party designated by you) take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
3.5 - Reserves
You must notify the post office and IMAROQ of any reservations you may have about the product delivered (for example: package damaged, already opened, etc.).
For security reasons in particular, IMAROQ will not process any order for which a post office box or Cedex address is provided.
Article 4-Refunds and returns
4.1- Withdrawal
For returns of products in stock, and within 14 days of receipt, IMAROQ guarantees a refund. Customers benefit from a right of withdrawal under Article L121-20 of the French Consumer Code. This applies to products pre-ordered on the www.ulule website and upon presentation of the invoice. After this 14-day period, no refund will be granted.
4.2 - Refunds
In order to be refunded, the product must be returned to us in its original packaging and in perfect condition (no scratches, no signs of wear, etc.). The refund will be made once we have received and checked the product.
4.3-Back
Any return of equipment under warranty must be subject to the prior agreement of IMAROQ. The product must be returned in its original packaging, in perfect condition, with all the accessories delivered and accompanied by a copy of the invoice. In order to facilitate the return, you must also complete the returns form and send it to our after-sales department by e-mail. sales@iletaitunfil.com to receive a returns number and all the instructions for returning the product for a refund or exchange.
The CLIENT shall only be liable for any depreciation of the good resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the PRODUCT. In other words, the CLIENT may test the PRODUCT but may be held liable if it carries out manipulations other than those necessary. IMAROQ shall not refund the Products concerned.
4.4-Return costs
The CUSTOMER shall bear the direct costs of returning the goods. Re-shipment costs (unclaimed parcel, data entry error, etc.) amount to 10 Euro excluding VAT (repackaging & management costs) + shipping costs.
The cost of changing an order (address, product reference, etc.) after 48 hours is €8 excluding VAT.
4.5-Refunds
Refunds will be made in accordance with article L.121-20-1:
When the right of withdrawal is exercised, the trader is obliged to reimburse the consumer for all sums paid, as soon as possible, and at the latest within 30 days of the date on which this right was exercised. Beyond this period, the sum due shall automatically bear interest at the legal rate in force. This reimbursement shall be made by any means of payment. However, at the proposal of the professional, the consumer who has exercised his right of withdrawal may opt for another method of reimbursement.
If the Customer fails to comply with these conditions, in particular the return or exchange conditions, IMAROQ will not be able to reimburse the Products concerned.
Article 5-Guarantees and liability
5.1 General information
Products must be returned to us in the condition in which you received them, together with all the components (accessories, packaging, instructions, etc.). You may be held liable for any depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and correct operation of the product. You are responsible for shipping costs.
The Product is guaranteed against manufacturing defects in parts and labour from the date of delivery.
Any action resulting from a lack of conformity shall be barred after one (1) year from the date of DELIVERY of the PRODUCT.
Any action arising from latent defects must be brought by the CUSTOMER within one (1) year of the discovery of the defect.
- The products sold by IMAROQ are subject to the legal guarantees provided by articles L 211-4, L 211-5 and L 211-12 of the Consumer Code and articles 1641 and 1648 of the Civil Code:
In accordance with Order 2005-136 of 17 February 2005 of the Consumer Code/Civil Code, here are all the applicable texts
Art. L. 211-4 of the French Consumer Code: The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was his responsibility under the contract or was carried out under his responsibility.
Art. L. 211-5. of the French Consumer Code: To be in conformity with the contract, the goods must: 1° Be fit for the use normally expected of similar goods and, where applicable: a) correspond to the description given by the seller and possess the qualities that the seller has presented to the Customer in the form of a sample or model; b) have the qualities that a Customer may legitimately expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labelling. 2° Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the Customer, brought to the attention of the seller and accepted by the latter.
Art. L. 211-12 of the French Consumer Code: Any action resulting from a lack of conformity shall be barred after two years from the date of delivery of the goods.
Art. 1641 of the French Civil Code: The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair that use to such an extent that the Customer would not have purchased it, or would only have paid a lower price for it, had he been aware of them.
Art. 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years of discovery of the defect.
5.2- IMAROQ commercial warranty conditions
Please note: The purchase invoice for the product serves as the guarantee. No duplicate will be issued.
Our products are intended for private individuals and are covered by a warranty excluding :
- AC adaptor, power cables.
- The battery , connectors . IMAROQ does not offer any express or tacit guarantee concerning the capacity of the equipment to satisfy the user's needs, the absence of error in its operation, the possible or effective correction of any defect in the system. Under no circumstances may IMAROQ be held liable for any direct or indirect prejudice of any nature whatsoever resulting from an imperfection in the system as a whole.
-Damage caused by misuse.
-Breakage, dropping, misuse or neglect of the product. In the event of transformation, modification or scratches to the product, the guarantee is void.
- Damage caused by an electrical surge.
- Damage caused by an external cause: lightning, shock, excessive pressure, presence of water and/or sand and/or dust, accident, power fluctuation, computer virus, oxidation, and more generally any body foreign to the appliance as well as resulting from abnormal use or use contrary to the manufacturer's instructions (as mentioned in the manuals supplied);
- Damage caused by any software not supplied with the equipment and by the connection of non-compatible peripherals.
- Bodily injury, property damage, moral damage or any other damage.
A service charge of thirty (39) euros including VAT will be made if the repair request is not covered by the warranty.

Article 6- Collection and disposal of WEEE
In accordance with decree no. 2005-829 of 20 July 2005 on the disposal of waste electrical and electronic equipment (WEEE), the user is responsible for collecting and disposing of WEEE under the conditions set out in articles 21 and 22 of this decree.
Article 7-Intellectual property
The IL ETAIT UN FIL brand is a registered and protected trademark. All elements (drawings, models, illustrations, images, soundtracks, texts, logos, brands, etc.) making up the www.iletaitunfil.com website are the exclusive property of IMAROQ SAS. You are prohibited from reproducing, in full or in part, by any means whatsoever, distributing, publishing, transmitting, modifying or selling all or part of the content of the www.iletaitunfil.com,ou website, or from creating derivative works from it.
Any reproduction, distribution, transmission, modification or use of this trademark without the express prior consent of IMAROQ, for any reason whatsoever, is prohibited.
Article 8 Limitation of liability
Under no circumstances will IMAROQ be held responsible for any damage caused by one of its products or accessories. You alone are responsible for any damage to your device.
Article 8 Applicable law - Disputes
These General Terms and Conditions of Sale shall be governed by and construed in accordance with French law, without regard to principles of conflict of laws. The present General Terms and Conditions of Sale do not prevent IMAROQ from complying with a public policy provision existing in the regulations of the European Union country from which the customer has ordered, provided that the customer is also domiciled there.
These General Terms and Conditions of Sale are written in French.
In the event of a dispute, the French courts shall have exclusive jurisdiction and you agree to accept their exclusive jurisdiction. SOCIETE IMAROQ reserves the right to seek and obtain injunctions or orders for the defence of its rights hereunder.
